Welcome to Golden Gates Life (“Golden Gates Life,” “we,” “us,” or “our”). These Terms govern your use of our Services. Please read them carefully.
1. Acceptance of Terms
By accessing or using the Golden Gates Life website, applications, and online tools, as well as any related services (collectively, the “Services”), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, you must not access or use the Services.
2. Modifications to Terms
Golden Gates Life may modify or amend these Terms at any time by posting updated Terms on this page with a revised effective date. Your continued use of the Services after the effective date of any modification constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
3. Privacy Policy; Data Practices
Your use of the Services is governed by our Privacy Policy, which is hereby incorporated by reference. The Privacy Policy describes our collection, use, disclosure, and safeguarding of personal information, including name, phone number, state, email address, and your consent preferences. You must promptly notify us of any unauthorized use or suspected breach of security.
6. License Grant; Reservation of Rights
Subject to your full compliance with these Terms, Golden Gates Life grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal or internal business purposes. Golden Gates Life and its licensors reserve all rights not expressly granted herein.
7. Intellectual Property
The Services, including all content, text, graphics, logos, icons, images, software, and other materials, are owned by Golden Gates Life or its licensors and are protected by intellectual property laws. Except as expressly permitted in these Terms, you may not copy, modify, distribute, sell, lease, or create derivative works of the Services or any portion thereof.
8. User Content; Feedback
You retain ownership of any content you submit through the Services (“User Content”). By submitting User Content, you grant Golden Gates Life a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, host, store, display, perform, adapt, and distribute such User Content in connection with operating and improving the Services. If you submit ideas, suggestions, or feedback (“Feedback”), you grant us a perpetual, irrevocable, royalty-free license to use the Feedback without restriction or obligation to you.
9. Prohibited Activities
You agree not to, and not to allow any third party to: (a) violate any law, regulation, or third party right; (b) infringe or misappropriate intellectual property or privacy rights; (c) upload, transmit, or distribute malware or other harmful code; (d) interfere with or disrupt the integrity or performance of the Services; (e) attempt to gain unauthorized access to the Services or related systems; (f) use any robot, spider, scraper, or other automated means to access the Services without our express written permission; (g) impersonate any person or entity, or misrepresent your affiliation with any person or entity.
10. Insurance Disclosures; No Offer or Guarantee of Coverage
Golden Gates Life is a life insurance agency. Product availability, features, carriers, underwriting guidelines, and eligibility criteria vary by state and by insurer and are subject to change without notice. Any quotes, rate illustrations, or eligibility estimates provided via the Services are non binding and for informational purposes only; final rates, terms, and benefits are determined solely by the issuing insurer after completion of its underwriting and review of required information. No information on the Services constitutes legal, tax, or financial advice.
11. Communications Consent (Calls and SMS)
By submitting your personal information through the Services, you expressly consent to be contacted by telephone at any lawful telemarketing hours and to receive up to ten (10) SMS/text messages regarding our Services, offers, reminders, and account related notices. You acknowledge that calls or texts may be placed using an automatic telephone dialing system and/or include prerecorded messages. Message and data rates may apply. Message frequency may vary up to the limit above unless you re consent. Consent is not a condition of purchase. You may opt out of SMS at any time by replying STOP; for help, reply HELP. Your opt out request may take up to a reasonable period to process. Even after you opt out of marketing messages, we may still send you non marketing communications permitted by law (e.g., transactional or account notices).
12. E SIGN and Electronic Communications
You agree to receive disclosures, notices, and other communications electronically and consent to the use of electronic signatures where permitted by law. You should retain copies of all electronic communications for your records. You may withdraw your consent to receive electronic communications by contacting us, but doing so may impact your ability to use certain features of the Services.
13. Call Recording and Monitoring
For quality assurance, training, and compliance, we may monitor or record telephone calls and other communications with you to the extent permitted by law.
14. Third Party Services and Links
The Services may reference or link to third party websites, products, or services that are not controlled by us. We are not responsible for the content, terms, or privacy practices of third parties, and your use of third party resources is at your own risk.
15. Fees and Payments
Some features may require payment. You agree to pay all applicable fees, taxes, and charges. Except as required by law or expressly stated otherwise, all payments are final and non refundable.
16. Availability; Changes; Beta Features
We do not guarantee that the Services will be available at all times or without interruption. We may modify, suspend, or discontinue any part of the Services at any time. We may also offer features identified as beta, preview, or trial; such features are provided as is and may be modified or discontinued without notice.
17. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR FREE OR UNINTERRUPTED.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.
19. Indemnification
You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the Services, or your violation of these Terms or applicable law.
20. Compliance; Do Not Call Requests
We maintain internal procedures to honor Do Not Call requests. To be added to our internal Do Not Call list, contact us using the information below. We will make commercially reasonable efforts to honor such requests in accordance with applicable law.
21. Export Controls and Sanctions
You represent that you are not located in, under the control of, or a national or resident of any country or territory subject to U.S. embargoes or sanctions, and you are not identified on any U.S. government restricted party list. You agree to comply with all applicable export control and sanctions laws.
22. Force Majeure
We shall not be liable for any delay or failure in performance resulting from events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor conditions, governmental actions, or internet or utility failures.
23. Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign or transfer these Terms without restriction.
24. Governing Law; Venue
These Terms are governed by the laws of the State of Indiana, without regard to its conflict of laws principles. All disputes arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Marion County, Indiana. You consent to the personal jurisdiction of such courts.
25. Severability; Waiver; Headings
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. Headings are for convenience only and have no legal effect.
26. Entire Agreement; Survival
These Terms, together with the Privacy Policy and any other documents expressly incorporated by reference, constitute the entire agreement between you and us regarding the Services. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and indemnification) shall so survive.

28. State Specific Licensing and Disclosures
Golden Gates Life operates in accordance with applicable state insurance licensing requirements. Certain products, riders, or features may be unavailable in some states. Nothing in the Services constitutes an offer or solicitation where prohibited by law.
